Introduction
a. Welcome to the Memex Chat Sync chatbot service. These Terms of Service ("ToS") are a legal agreement between you and Literary Machines, Inc. Public Benefit Corporation ("Company", "we", "us", or "our"), a public benefit corporation registered in Delaware, and govern your use of our chatbot program which creates an archive of all links posted in a Discord or Slack channel available at https://memex.garden ("Service").
Acceptance of Terms
a. By accessing or using the Service, you agree to be bound by these ToS. If you do not agree to these terms, please refrain from using the Service.
Eligibility
a. The Service is available to users of all ages. By using the Service, you represent that you have the legal capacity to enter into this agreement.
Pricing
a. The Service is currently provided free of charge.
Data Handling and Deletion Requests
a. The Service creates an archive of all links posted in a designated Discord or Slack channel. For requests pertaining to data deletion or any other concerns, users are asked to contact [email protected].
Termination
a. Users may request the deletion of their account and associated data by contacting [email protected]. We reserve the right to suspend or terminate the Service or a user's access to the Service for any reason, including any misuse.
Limitation of Liability and Warranties
a. The Service is provided "AS IS" and on an "AS AVAILABLE" basis without any warranties of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
b. In no event shall Literary Machines, Inc. Public Benefit Corporation, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, opportunities, reputation, profits or revenues, related to the Service (e.g. offensive or defamatory statements, downtime or loss, use of, or changes to, your information or content).
c. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that data loss will not occur.
Governing Law and Jurisdiction
a. These ToS shall be governed by and construed in accordance with the laws of the state of Delaware. Any disputes relating to these ToS shall be subject to the exclusive jurisdiction of the courts of Delaware.
Modifications to the ToS
a. We may modify these ToS at any time. When we do, we will provide notice of such changes by posting them on our website or by sending you an email. It is your responsibility to review the ToS periodically.
